How to nominate an Asset of Community Value

Community groups who may make a nomination:

  • parish or town councils
  • unincorporated bodies (must have at least 21 members who are locally registered to vote, and must not distribute any surplus it makes to members)
  • charities
  • companies limited by guarantee who do not distribute surpluses to its members; or
  • community interest companies 

A building or piece of land is an asset of community value if it is at least partly within Uttlesford district and its main use has recently been to further the social wellbeing or social interest of the local community and it could do so in the future.

If land or buildings on the list come up for sale in the future, then the local community has a period of six months to raise funds and prepare a bid to buy the asset.

Nominations must include:

  • a description of the nominated asset including its boundaries
  • the names of current occupants of the asset and anyone having a freehold or leasehold estate in the land
  • your reasons for thinking that the asset is of community value and
  • evidence that you are eligible to make a community nomination 
  • supporting information to evidence use of the nominated asset by the local community 

You can propose an asset using our nomination form.  It is important that you also submit supporting information to present your case and evidence how the buildings or land are used by the local community.   Please email the nomination form and supporting information to us at planningpolicy@uttlesford.gov.uk

We will consider each nomination and decide whether to put the asset on the list of local Assets of Community Value. A report is prepared by a Case Officer, and decided by a Senior Manager of the Local Plan & New Communities Team, following consultation with the Head of Legal, and the Cabinet member who is Chair of the Assets of Community Value and Local Heritage List Committee.

If we decide not to list the asset we will explain why. If the asset is listed and the owner disagrees, the owner could ask us to review its decision. If we confirm our decision to list it, the owner can then appeal to a tribunal.

Assets of Community Value list

The council's Cabinet has resolved to agree assets to be included on the Assets of Community Value list. The Cabinet has also agreed a list of unsuccessful, or not listed, community nominations.

Appeals

An owner of a designated asset can appeal the decision to register the property. This must be completed in writing and should be addressed to the Chief Executive at the .

We have a compensation claims procedure and procedure for the review of decisions.
 

Notification to sell an asset

If the registered owner intends to sell a registered asset then they must inform us of this decision. This triggers the moratorium on any sale until such time as the protected period(s) have expired.

You should write to the Strategic Director of Planning at the .

You need to include the details of the property, details of ownership and full contact details.

We will then notify the relevant parish or town council or community organisation to see if they wish to consider purchasing the asset.
